1. Seller identityThese Terms and Conditions of Sale (T&Cs) apply between:

Hereinafter referred to as “the Seller”, and any natural person of legal age making a purchase on the website, hereinafter referred to as “the Customer”.



2. Purpose These T&Cs define the rights and obligations of the parties in the context of the online sale of products offered by the Seller.
The Seller reserves the right to modify these T&Cs at any time. The applicable version is the one in force on the date the order is confirmed.



3. Access conditions and orders Orders are reserved for natural persons aged at least 18 years.
Any order implies full and unconditional acceptance of these T&Cs.
Products added to the cart are not reserved. An order is considered final only after payment validation and receipt of the confirmation email.
The Seller reserves the right to refuse or cancel any order for legitimate reasons (fraud, prior dispute, technical issue, etc.).



4. Products - artisanal nature The products offered are designed and manufactured in an artisanal manner in France, in a Parisian workshop.

Due to this artisanal production:
  • slight variations (shape, color, texture, finish) may occur
  • these characteristics do not constitute defects but are part of the product’s uniqueness

Images displayed on the website are non-contractual.



5. Pricing Prices are shown in euros (€).

VAT:
The Seller operates under the VAT exemption scheme (Article 293B of the French General Tax Code).
VAT not applicable – Article 293B of the French General Tax Code.

Prices do not include delivery fees.
For orders outside the European Union, customs duties and taxes may apply. These are the sole responsibility of the Customer.
The Seller reserves the right to modify prices at any time, without affecting already confirmed orders.



6. Payment Payment is due in full at the time the order is placed.

Accepted payment methods are those available at checkout and may include, without limitation:
  • Credit and debit cards (Visa, Mastercard, American Express depending on availability)
  • Apple Pay
  • Google Pay
  • PayPal

Payments are processed securely through third-party payment service providers.
The Seller does not store any banking or payment card data at any time.



7. Nature of Products and Production Lead Times7.1 Distinction between Standard Products and Special Requests All products listed on the website are handcrafted upon order validation. However, a legal distinction applies regarding the right of withdrawal :

A. Standard Products (Eligible for Return)
These refer to models presented on the website, manufactured according to the technical and aesthetic specifications defined by the Seller (selection from available sizes, colors, and materials in the catalog).
Although these products are manufactured only after the order is placed, they are not considered “customized” within the meaning of the law. Consequently, the 14-day right of withdrawal applies in full to these items.

B. Special Requests (Ineligible for Return)
These refer to products for which the Customer has requested a specific modification not included in the Seller’s standard offer (e.g., non-standard length, altered proportions, or specific details).
Any such modification must be expressly confirmed by the Seller prior to production. By validating a Special Request, the Customer acknowledges that the product is made according to their specifications.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to these products.

7.2 Production Lead TimesAn estimated production lead time is indicated on each product sheet. This timeframe is provided for indicative purposes only. Due to the artisanal nature of the work, it may vary (due to high activity levels or supply chain constraints). The total delivery time corresponds to: Production Lead Time + Shipping Time (see Section 8).

7.3 Cancellation prior to ShipmentFor Standard Products, any cancellation after order validation is possible provided that production has not yet commenced. If production has begun, fees corresponding to materials and labor incurred may be deducted. For Special Requests, the order is firm and definitive upon validation and cannot be cancelled, as production is launched immediately based on the Customer's unique specifications.


          
8. Delivery Methods and rates:
  • France, Monaco, Andorra – Colissimo: €7.50
  • Europe – DHL Express: €14
  • International – DHL Express: €22

Estimated delivery times after dispatch:
  • France: 2–5 working days
  • Europe: 5–8 working days
  • International: 5–8 working days

The Seller cannot be held responsible for delays attributable to carriers.



9. Customs duties Orders outside the EU may be subject to customs duties and taxes.

These costs are:
  • not included in the price
  • borne by the Customer
  • payable to the carrier prior to delivery



10. Right of withdrawal - returns and refunds10.1 General Principle (Standard Products) In accordance with Article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt to exercise their right of withdrawal on Standard Products (see definition in Section 7.1.A), without having to provide any justification.

10.2 Exclusion of the Right of Withdrawal (Special Requests) The right of withdrawal does NOT apply to products subject to a "Special Request" (see definition in Section 7.1.B).
This concerns items modified according to the Customer's instructions (e.g., made-to-measure length, specific detail, particular adaptation).
By validating an order including a special request, the Customer expressly acknowledges waiving their right of withdrawal for said item. 
No return or refund will be accepted on this basis, except in cases of non-conformity or hidden defects.

10.3 Return Conditions (Standard Products Only)
For eligible Standard Products, returns are accepted only if :
  • The product is strictly new, never worn, used, or washed
  • It is free from any odors (perfume, tobacco, etc.)
  • All original tags are present and intact
  • The original packaging is complete and in perfect condition

The Customer remains liable for any diminished value of the goods if such diminution results from handling other than that necessary to establish the nature and functioning of the product. 
A financial deduction may be applied to the refund in the event of observed depreciation.

10.4 Return procedure
  • The Customer must send a request via email to: contact@paulchery.com, specifying the order number and the reason for the return.
  • The Seller will confirm in writing whether the product is eligible for return (verification of "Standard" vs. "Special Request" status).
  • Once authorization is received, the Customer shall ship the package at their own expense. Any return made without this prior validation will be refused.

10.5 Fees and Refund Terms
  • Return Shipping Costs : Borne exclusively by the Customer.
  • Risk : The Customer is responsible for the package until its receipt by the Seller (tracked and recommended shipment advised).
  • Refund Timeline : Within 14 days maximum following receipt and inspection of the product.
  • Refund Amount : Product price + standard shipping costs (the least expensive option). Express shipping fees and any applicable customs duties are non-refundable

10.6 Abuse
The Seller reserves the right to refuse future orders in cases of abusive returns or repeated disputes.



11. Legal warranties Products benefit from applicable legal warranties:
  • legal guarantee of conformity
  • warranty against hidden defects

These apply independently of the right of withdrawal.

11.1 Implementation
In case of defective or non-compliant product, the Customer must contact: contact@paulchery.com with supporting evidence (photos and description).
After validation, an appropriate solution will be proposed: repair, replacement, or refund.

11.2 Coverage Under legal warranties, return shipping costs are covered by the Seller.

11.3 Exclusions Warranties do not cover:
  • normal wear and tear
  • improper use
  • lack of maintenance
  • modifications made by the Customer



12. Liability The Seller’s liability is limited to the amount of the order.

The Seller cannot be held responsible for:
  • improper use of the product
  • normal wear and tear
  • indirect damages



13. Product care The products offered are textile items requiring appropriate care.
The Customer must follow care instructions on the label or product page.

The Seller cannot be held responsible for any alteration, deterioration, or damage resulting from:
  • improper washing or drying
  • failure to follow care instructions
  • improper use
  • incorrect or insufficient maintenance

These provisions do not affect applicable legal warranties.



14. Intellectual property All website content is protected.
In cases of co-owned content (e.g., photography), rights are used under contractual authorization.
Any reproduction is prohibited without prior permission.



15. Applicable law These T&Cs are governed by French law.
In case of dispute, an amicable solution will be sought before any legal action.
